NHS Provider licence: Self-certification

The NHS Provider Licence was introduced in 2013 following the Health and Social Care Act 2012 to regulate providers and ensure the health sector works in the best interests of patients. The NHS provider licence forms part of the oversight arrangements for the NHS and sets out conditions that providers of NHS-funded healthcare services in England must meet to help ensure that the health sector works for the benefit of patients, now and in the future.

From 2013, all NHS foundation trusts are required to hold a licence. The licence was modified and re-issued in 2023 as a new Provider Licence, effective 1 April 2023 and to reflect current statutory and policy requirements.

NHS Foundation Trusts must self-certify that they can meet the applicable conditions set out in the NHS Provider Licence, through the annual reporting process. Certifiable conditions applicable to the Birmingham and Solihull Mental Health Foundation Trust are:

Condition G3 — The Trust must have systems and processes in place to ensure that all Governors and Directors are Fit and Proper Persons.

Condition G5 — The Trust must have systems and processes in place to ensure compliance with its licence conditions and take all reasonable precautions against the risk of non-compliance.

Condition NHS1 — The Trust must make its Constitution and Annual Report and Accounts available to NHS England.

Condition NHS2 — The Trust must apply appropriate principles, systems, and standards of good governance to ensure consideration of NHS England guidance on delivering net zero emissions, digital maturity, Board effectiveness and accountability, efficient, economic and effective operations, effective organisational leadership, and quality of care.
